1. General
1.1. These Terms of Service ("Terms") apply to all purchases made on [website address] (the "Store"), operated by [company name], registry code [number], address [address], email [email], phone [phone] (the "Seller").
1.2. By placing an order, the customer ("Buyer") confirms that they have read and accepted these Terms.
1.3. The Buyer must be at least 18 years old and have legal capacity to enter into a contract.
2. Products and Intended Use
2.1. The Store sells GP-5 gas masks and related accessories. Unless the product page explicitly states otherwise, GP-5 masks are surplus or used items sold for collecting, display, reenactment, and educational purposes.
2.2. Surplus masks and filter canisters are not sold as certified personal protective equipment and must not be relied on for protection against chemical, biological, radiological, or other hazards. The Seller gives no guarantee of protective performance.
2.3. Product photos are illustrative. The condition, manufacturing year, size, and included components are described on the product page. Minor differences between units of the same model are possible.
3. Orders and Contract
3.1. The contract is concluded when the Seller confirms the order by email.
3.2. The Seller may refuse or cancel an order if the item is out of stock, the price was published in error, or the order appears fraudulent. Any payment made will be refunded in full.
4. Prices and Payment
4.1. Prices are in euros and include VAT where applicable. Delivery costs are shown separately at checkout.
4.2. Accepted payment methods: [bank link / card / other].
4.3. Ownership passes to the Buyer once full payment is received and the goods are delivered.
5. Delivery
5.1. Delivery methods, costs, and estimated times are shown at checkout. Standard handling time is [X] business days.
5.2. Risk of loss passes to the Buyer on delivery. The Buyer should inspect the package on receipt and report visible transport damage immediately, ideally before accepting it from the carrier.
5.3. For deliveries outside Estonia, the Buyer is responsible for checking and complying with local import rules, customs duties, and any restrictions on gas masks or military surplus in their country. The Seller may decline orders to destinations where such items are restricted.
6. Right of Withdrawal (Consumers)
6.1. A consumer may withdraw from the contract within 14 days of receiving the goods, without giving a reason.
6.2. To withdraw, send a clear statement to [email] (a withdrawal form is available on request) and return the goods within 14 days of notifying the Seller.
6.3. Goods must be returned in the condition received, unused, and with all original components. The Buyer pays the direct cost of returning the goods unless the Seller states otherwise.
6.4. The Seller will refund the price, and standard delivery costs, within 14 days of receiving the withdrawal notice, using the same payment method. The Seller may withhold the refund until the goods are received back or proof of dispatch is provided.
6.5. The Buyer is liable for any reduction in value caused by handling beyond what is needed to inspect the goods.
7. Conformity and Complaints
7.1. The Seller is liable for goods that do not conform to the contract, in accordance with the Estonian Law of Obligations Act. Used and surplus items are sold as described on the product page.
7.2. To make a complaint, contact [email] promptly after discovering the defect, with your order number, a description of the problem, and photos.
7.3. The Seller will respond within [15] days. Remedies may include repair, replacement, price reduction, or refund, as provided by law.
7.4. The Seller is not liable for damage caused by improper use or by use of the goods for a purpose other than the one stated in section 2.
8. Liability
8.1. The Seller is not liable for any use of the products as protective equipment (see section 2.2).
8.2. Nothing in these Terms limits the Buyer's statutory consumer rights or the Seller's liability for intent or gross negligence.
9. Personal Data
Personal data is processed as described in our Privacy Policy at [link], in accordance with the GDPR.
10. Disputes and Governing Law
10.1. These Terms are governed by the laws of the Republic of Estonia.
10.2. The parties will first try to resolve disputes by negotiation. A consumer may also turn to the Consumer Disputes Committee (Tarbijavaidluste komisjon), www.tarbijakaitse.ee, or to the courts.
11. Changes
The Seller may update these Terms. The version in force at the time of the order applies to that order.
